1 Privacy Policy

The data protection declaration describes how Hosang Consulting GmbH handles your personal data and ensures the implementation of data protection. Data processing takes place on a dedicated server in Switzerland, as well as in Microsoft’s data centers in Ireland and Amsterdam. As an employee, partner or contractual partner, you agree to the present data protection declaration on the processing of personal data by Hosang Consulting GmbH by placing an order with Hosang Consulting GmbH and by the resulting cooperation with Hosang Consulting GmbH. In the text there is no explicit differentiation between the female and the male form for the sake of better readability; however, both are always meant.

 

 

2 Introduction

For Hosang Consulting GmbH data security and protection of your personal data is a matter of course. All data, in particular personal data, which you entrust to us must be treated confidentially and for the intended purpose in compliance with the statutory provisions on data protection.

 

3 Principles

The following principles apply to the processing of personal data:

Personal data will only be processed if and as long as permission or obligation exists! Data will only be used to the extent necessary to achieve a legitimate purpose. Data that are not relevant for the achievement of a specific purpose are not processed. The duration of the processing must also be limited to the necessary extent.
Any processing will only take place taking into account the interests and expectations of the parties concerned. Personal data will only be used to the extent that this is unavoidable in order to achieve a legitimate purpose and reasonable for the data subject. We respect the rights of data subjects, in particular the right to information.
We treat all personal data confidentially! Data will only be made accessible to persons or processes if and as long as this is necessary in individual cases. This restriction applies both to data collections as a whole and to the detailed information contained therein. Hosang Consulting GmbH is the data processor responsible for the processing of all personal data in the context of interaction with customers, customers, freelancers and IT specialists.

 

4 Data Protection Officer

In principle, all employees are called upon to actively support the data protection efforts of the company and to ensure the correct implementation of specifications in their area of responsibility. They are trained accordingly and continuously sensitized. Employees are given appropriate guidance.
The legal responsibility for compliance with data protection always lies with the management. The implementation of the measures initiated by the management can also be delegated to other persons.

5 Processing of your personal data

5.1 Groups of persons

We process personal data from various groups of people. Individual persons can also belong to several groups of persons.
– Employees, Applicants, Candidates
– Cooperation partners, business partners, contact persons, suppliers

5.2 Data types

In order to offer you the best possible service and to comply with our legal obligations, we have to process a large amount of personal data. This may include data such as

First name and surname, place and date of birth,
Sex, age, marital status
Contact data (postal, telephone, e-mail, portals)
Curriculum vitae, applicant photos, professional experience and stations, projects, activities and focal points
Certificates, references, certificates of good conduct (if necessary)
Education, academic degrees, skills (competences), fields of application, language skills
Identity card number, social security number/tax ID, health insurance and pension insurance data, religious affiliation, nationality, residence status, driver’s license classes
Personnel number, remuneration, salary data, health data, bank data, working hours and initial absences

5.3 Data origin

As a rule, we only process the data that you have provided directly to us. You can provide us with data in various ways, e.g. by e-mail, telephone, via our website, or via job or project offers which you forward directly or indirectly to us, via a personal contact. We also process personal data from third party sources if they are made available to us in a legally compliant manner. Also in the course of a cooperation with us, personal data, which become known due to the cooperation, can be processed.

5.3.1 Purpose of processing

The purpose of our processing always depends on the group of persons to which you belong.

5.3.2 Employees

We process your data for the purpose of fulfilling our obligations as an employer arising from the employment relationship between you and us.

5.3.3 Applicants/ Candidates

We process your data in order to find the right employment or project for you. You control which data we can use from you for this purpose and which data you make available to us. The better we know your skills, experience and interests, the better we will be able to find the right employment opportunities or projects for you.

5.3.4 Cooperation partners/ business partners/ contact persons/ suppliers

We only process the data that we need to ensure the smooth running of the contractual relationship between you and us or that is in the process of being established. In addition, data of third parties may be processed to the extent that they may be legally processed, such as creditor information. Further information and data which we receive from you may also be processed.

5.4 Place of processing

We process your data on servers and EDP systems within the European Union or within the European Economic Area.
In individual cases, your personal data may also be processed in third countries, for example when using certain software. Before such processing is introduced, we always check that an appropriate level of protection is maintained by our data protection officer and comply with the recommendations of the Federal Office for Information Security and the Hessian Data Protection Commissioner.

5.5 Technical and organisational measures

As part of our data protection concept, which is based on internationally recognised standards, we have taken numerous technical and organisational measures to ensure the security, confidentiality, integrity and availability of your data in our companies and to prevent abusive data processing.

 

6 Transmission of your data

 

6.1 Employees

We transmit data of our employees only in the context of our obligations from the existing employment relationship, for example to the health insurance company, to the tax administration or our payroll accounting. In the case of personnel hire or employees who are employed by third parties, further personal data, such as profiles or working hours, will be transferred between us and third parties for the purpose of positioning and for the purpose of the obligations arising from the existing employment relationship.

6.2 Applicants / Candidate / Cooperation Partners

In order to find the right project or job for you, we forward your profile to potential employers/project managers to help you make the right decision. These third parties are exclusively our customers, business or cooperation partners, i.e. partners with whom we are in contact.

6.3 Cooperation Partners / Business Partners / Contact Persons / Suppliers

In fulfilment of our contractual obligations, personal data of cooperation partners/business partners/contacts/suppliers may also be transmitted to third parties insofar as this is necessary for the fulfilment of the contract. In certain cases regulated by law, we are also obliged to transmit personal data to authorities. This requires a written request by the authority requesting information as well as at least a probable obligation to cooperate. Obviously inadmissible requests for information will also be rejected by us vis-à-vis the authorities.

 

7 Up-to-dateness of your data

The legislation obliges to work with current data and to keep data records up to date. You personally are the central data source for us. We would therefore like to thank you for your trust and support in updating your data. Please do not hesitate to inform us of any relevant changes. Only if we can work with current data can we find the right project for you.

 

8 Processing time

We only process your data for as long as we are legally obliged to do so or you have consented to the processing. If you apply for a specific position or project, you agree that we may process your personal data in our system in order to be able to consider you for any other positions or projects. In this case, we will include you in our database with the documents you send us.

 

9 Procedure for automated decision-making

We do not use automated decision making processes.

 

10 Up-to-dateness of data protection provisions, changes

We keep our data protection at an appropriate level. Due to legal or technical developments it may become necessary to adapt or change our procedures. Your consent will continue to apply in these cases of change, which are always subject to objective justification. Unless you expressly object to the change. We will always inform you about changes through publication, for example on our websites. If the changes are of a considerable extent, we will ask you again for your consent to the changed data protection regulations by e-mail. In the event of failure to give your consent or your consent being revoked, we shall be entitled to terminate the contracts with you without notice.

 

11 Your rights as affected party

As a person affected by the processing of your data, you have the following rights vis-à-vis us as the processing authority:

We have a legal deadline of four weeks for processing your comments, which can be extended by a further four weeks in exceptional cases. We endeavour to process your request completely within the first four weeks after receipt of your request. Please note that, due to legal storage periods, we may still be obliged to store certain personal data about you even after an application for deletion or “being forgotten”. 12 Validity

This privacy policy applies indefinitely from the date of its publication. The validity of this data protection declaration is cancelled by the announcement of a successor data protection declaration.
